Terms and Conditions
The Contract
Please note that it is essential to read and understand the following terms and conditions. This is a contract between you and Machu Picchu Day Trip (Aantur Peru). When you make your reservation and pay your deposit, you acknowledge that you have read and agree to the following terms and conditions. Additionally, ensure that you have read and understood the itinerary and the travel style you will be participating in.
These are the terms and conditions that govern the relationship between Aantur Peru, hereinafter referred to as “Aantur Peru” or “the company,” and you, hereinafter referred to as “the client.”
Program and Service Prices
All prices are listed in U.S. dollars and include all taxes for non-residents of Peru. All airfare and bus rates are subject to change and availability. They will be confirmed on the ticket purchase date.
All group departure prices are based on shared double occupancy. If you are a solo traveler, you will be paired with another traveler of the same gender or you may pay a single supplement. All credit card payments are subject to an additional fee.
Reservations and Deposit
At the time of booking, a non-refundable deposit of 50% is required to reserve your hike, and the full payment is due 30 days before the start of the hike. If a reservation is made within a 30-day period of a hike or tour, the entire reservation must be paid in full at the time of booking. Please note that the Inca Trail must be booked well in advance as government permits can sell out up to 5 or 6 months ahead of time. Please consult us for availability.
Cancellation of Services by the Client
Any cancellation made by the client before 30 days will result in the loss of your deposit. Cancellations after this time will result in the loss of all money paid.
Cancellation by the Company
The company will only cancel a tour for the following reasons.
- “Force majeure” (see below)
- Unforeseen circumstances beyond the company’s control.
The company will inform the client of a cancellation as soon as possible. Clients with a fully paid reservation can choose between an alternative trip when possible or a full refund. The company is not responsible for any unforeseen expenses the client may have incurred as a result of the reservation, such as visas, vaccinations, non-refundable flights, or loss of enjoyment, etc. If the chosen alternative trip is of lesser value than originally booked, you are entitled to a refund of the price difference. If the chosen alternative tour is of higher value, the client will pay the difference in price.
Please note that no refunds will be given for the following:
- Lost travel time or replacement of facilities.
- The presence of circumstances outside the company’s control that require alternative arrangements to ensure the safety and enjoyment of your tour.
- Unused services for any accommodation, activity, or travel segment without prior notice.
- Premature termination of the contract.
Unused Services
If, for any reason, the transportation chosen by the client (bus, flight, train, etc.) does not arrive at the destination before or on the scheduled date and time to begin the services contracted by the company, the company will not be held responsible for the resulting missed services. The company will begin providing services from the client’s arrival date until the originally scheduled completion of the services. Any missed services as a result of these delays are non-refundable. If the client leaves the tour early, which includes not using additional accommodation nights for any reason, whether voluntary or involuntary, no refund will be given.
Prices and Surcharges
As we publish our prices well in advance, we may occasionally face significant cost increases due to factors beyond our control. As such, we reserve the right to impose surcharges (price increases) up to one month before departure if government actions or others compel us to do so; such cases include, but are not limited to, significant changes in exchange rates, increases in entry fees, train fares, or other transportation cost taxes. Any surcharge or price increase will be fully explained and justified by the company before implementation. If any surcharge results in an increase of more than 10% of the program cost, the client may cancel the reservation and receive a full refund, minus any expenses already incurred, provided the cancellation is made within the required time period.
Included Meals
On all flights and ground transportation, meals and snacks are provided to passengers according to the transportation company’s policy. Some programs include meals specified in the itinerary. These are described as B (Breakfast), L (Lunch), D (Dinner). All other meals are the responsibility of the client.
Flexibility
The client appreciates and acknowledges that the nature of traveling to developing countries requires considerable flexibility and should allow for alternatives. It is understood that routes, schedules, itineraries, services, and modes of transportation may be subject to changes without prior notice due to local circumstances or events, which may include illness or mechanical breakdowns, flight cancellations, strikes, events arising from political disputes, entry or border difficulties, weather, and other unpredictable circumstances. If hotels need to be changed, they will be replaced with hotels of a similar level.
Factors Beyond the Company’s Control (Force Majeure)
The company will do its best to minimize the effects of matters beyond its control but cannot accept any liability for these matters, which include, but are not limited to, political disputes, border closures, visa refusals, industrial actions, delayed flights, unpredictable weather, landslides, etc. The client agrees to bear all additional costs arising from any of these factors.
Authority on the Tour
At all times, the decision of the leader or company representative will be final in all matters that may endanger the safety and well-being of the tour. By booking with us, the client agrees to comply with the authority of the tour guide or representative, who represents the company. If the client decides not to comply with the decisions made by the company’s representative, it will be considered that the client has left the tour. The client must at all times strictly comply with the laws, customs, foreign currency, and drug regulations of all countries visited. If the client is affected by any condition, medical or otherwise, that may affect the enjoyment of the tour by others, the client must inform the company at the time of booking. If the client does not comply with the above or commits any illegal act during the trip,
Acceptance of Risk
Some of the company’s itineraries are designed to provide participants with exposure to the true nature of the environment visited. Therefore, they involve an element of personal risk and exposure to danger, which could, among other things, result in physical or emotional injuries, paralysis, death, or damage to the client, their property, or third parties. The client understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity and, therefore, assumes the risks as part of the tour. The client agrees that he/she is aware of his/her physical health conditions and, in that knowledge, assumes the aforementioned risks. The client releases the company from any liability related to any accident or injury that may occur associated with the client’s health, physical condition, or otherwise.
PHOTO APPEARANCE RELEASE:
By this, you authorize and grant permission to Aantur Peru and/or those with written consent from Aantur Peru to use photos or videos of you for the purpose of promoting future Aantur Peru programs. You expressly release Aantur Peru, its agents, employees, licensees, and assignees from any claims you have or may have for invasion of privacy, defamation, or any other cause of action arising from the use of these photographs and video images. If you do not wish your image to be used in our promotional material, please indicate so at the time of booking.
HOLIDAY SURCHARGE
For our wellness trips and our multi-day wellness programs and retreats, we pay a surcharge to our field staff (guides, cooks, and porters) if their work takes them away from their homes on the following holidays:
- Christmas Eve (December 24) and Christmas Day (December 25)
- New Year’s Day (January 1).
- Holy Thursday and Good Friday during Holy Week (the date changes year to year)
- Peru’s Independence Day (July 28).
The surcharge to the client for each holiday worked is $100 per holiday.
TOUR PRICE EXCLUSIONS
The following items are excluded from the tour price:
- Travel to and from the tour departure point.
- Personal travel insurance.
- Visa, passport, and vaccination expenses.
- Departure, airport, and airline taxes.
- Meals, transportation costs, entry fees, accommodation costs, or other expenses not described in the itinerary.
- Laundry, shipping expenses, personal clothing, medical expenses, and other personal items.
- Emergency evacuation and/or search charges; and tips, alcoholic beverages, and excess baggage.

Please note that information about these matters or related items is provided in good faith but without liability on the part of Aantur Peru.
FORCE MAJEURE
If it is prevented (directly or indirectly) for Aantur Peru to fulfill any of its obligations under this agreement due to an act of God, strikes, business disputes, fires, breakdowns, transportation disruptions, government or political actions, acts of war or terrorism, actions by or omissions of a third party, or any other cause beyond Aantur Peru’s reasonable control, Aantur Peru will have no liability, including financial liability, to you and may, at its discretion, by written notice, cancel the tour or take any other action as specified in our conditions.
AIRLINE
Any material published by Aantur Peru, the Booking Form, and these contract terms are not issued on behalf of nor do they bind any airline whose services are used or proposed to be used during the tour. Aantur Peru will make its best effort to ensure that all flight prices and prepaid taxes are correct at the time of quotation. Airlines reserve the right to modify or withdraw fares without prior notice. When you, the client, make a deposit for your trip, you commit to the travel dates. Flight reservations are non-transferable and are generally non-refundable or changeable.
AGE REQUIREMENTS: apply only to TREK bookings
We do not accept TREKKING bookings for children under 8 years old and adults over 68 years old. All children under 18 must also be accompanied by an adult on all programs offered by Aantur Peru. We recommend that if you are over 60 years old, you should consult your doctor in advance about the best way to plan the trip and also to ensure that your travel insurance covers such adventure activities, especially regarding limits on high-altitude activities. We also insist that clients over 60 arrive in Cusco at least 3 days before starting the hike (instead of the usual 2 days). For hikers over 63 years old, we also ask that you bring a letter from your doctor confirming that you are fit to participate in the hike.
MEDICAL DISCLOSURE
Individuals with heart problems, knee issues, severe asthma, or who are more than 18 weeks pregnant should not participate in hikes but may participate in non-trekking tours by providing our medical form signed by your doctor. Individuals with mild asthma, diabetes, or who are less than 18 weeks pregnant must bring a medical letter from their doctor indicating that they are fit to undertake a hike. They will also be required to be accompanied by a trekking companion during the hike at all times, who will travel alongside them and be familiar with any required medication in case of an emergency.
Your payment of a deposit is the declaration that:
- You are in good health and in good physical and mental condition at the time of booking this tour.
- You have disclosed to Aantur Peru all matters related to your health and physical and mental condition that you are aware of, or should reasonably be expected to know, are relevant to Aantur Peru’s decision to allow you to participate in the tour. In the event of any adverse change in your health or physical condition that may affect Aantur Peru’s decision to accept the risk of allowing you to participate in the tour, you WILL IMMEDIATELY notify Aantur Peru in writing.
You acknowledge that the obligation to disclose under this condition continues from the time of booking until departure and extends for the duration of the tour. If you fail to comply with the duty to disclose under this condition and Aantur Peru allowed you to undertake the tour or continue participating in the trip, had you made the full disclosure under this condition, Aantur Peru will not be held responsible for personal injuries, death, or property damage, losses incurred by you, or the cancellation of your program and any related expenses.
TRAVEL DOCUMENTATION
The client must possess a valid passport and all required visas for the entire trip, and the client accepts the responsibility of obtaining them. Any information or advice provided by the company regarding visas, vaccinations, weather, clothing, luggage, special equipment, etc., is given in good faith but without liability on the part of the company.
INSURANCE
It is mandatory for all clients to obtain travel insurance that covers personal injuries, medical expenses, repatriation expenses, and evacuation expenses. Insurance policies must cover sufficiently high altitudes to include all altitudes at which the client will be present. Clients must be able to provide proof of insurance to the company representative. It is highly recommended that the client’s insurance also covers cancellation and interruption, reduction, loss of belongings, and all other expenses that may arise as a result of loss, damage, injury, delays, or inconveniences that occur to the client. The company will have no liability for loss, theft, or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the client in public lounges or other public areas, whether aboard a ship, train, etc.
CLAIMS AND COMPLAINTS
If a client complaint arises while on tour, you must first notify the local representative or tour leader so that the company can attempt to resolve the situation on the ground. If the client is not satisfied with the resolution offered by the company representative, the client should contact the company with any complaints. If, at the end of the visit, the client is still not satisfied with the service, they must send their feedback in writing to the company at reservas@aanturperu.com.
LIABILITY FOR YOUR TOUR
All services here are organized by the company. It is hereby notified that all arrangements made on behalf of clients are made by the organizers with the sole condition that the organizers are not responsible for any injury, death, accident, delay, loss, damage, or irregularity that may be caused by acts of any company and/or persons involved in carrying out the arrangements. The company acts as an agent for transportation companies, hotels, and other contractors and will not be liable for any injury, damage, loss, delay, or irregularity that may occur, including, but not limited to, any defect in a vehicle or any other form of transporting a traveler, acts of God, detention, delays, or expenses arising from quarantine, strikes, riots, theft, force majeure, civil disturbances, government restrictions or regulations, accidents by airplane, boat, bicycle, motor vehicle, horse, or any other form of transportation, or in any hotel or guesthouse, boarding house, or other form of accommodation. The client acknowledges the quality of the products organized by the company, including accommodations and all other services related to the tour organized by the company, which are not under the company’s control and that, in any case, the quality of such products may be compromised by local conditions.
Consequently, the client releases the company from all claims and causes of action arising from damages, loss of enjoyment, inconvenience, or injuries related to the quality of such products. The information contained in all company documentation in brochures, on the website, or in flyers is correct to the best of the company’s knowledge and has been compiled in good faith. The company assumes no liability for your right to alter any ongoing itinerary or service at any time without penalty to the company. Any additional expenses or cancellations will be borne by the client at the discretion of Aantur Peru or its representatives. Payment of the deposit is taken as acknowledgment and agreement to the above items.
Governing Law and Choice of Forum
This agreement shall be governed by the laws of Peru. Each party agrees to the exclusive jurisdiction of the Federal Court of Peru in Cusco, Peru, regarding any action or proceeding related to this agreement.
